Modifying Child Support Payments
In New York, child support payments can be increased or decreased if there is a significant and continuing change in the financial circumstances of the person paying child support.  For example, if you are forced to take a lower-paying job than you had at the time of your divorce, you can have your child support payments reduced through a post-divorce modification.  Child visitation rights and custody can also be modified.

Enforcements of Child Support and Visitation
The New York family court can find spouses in contempt of court if they do not provide visitation or child support as required.  In addition, if the parent with custody continues to refuse to provide you access to your children, you may be able to get custody of your children.  It’s important to remember that you can’t hold back child support payments if you are denied visitation.

Adoptions and second-parent adoptions
The state of New York has a unique law called second-parent adoptions that allows gay couples to adopt children.  In a second-parent adoption, one parent will adopt a child and the second parent is simply the second parent, without regard to marital status or sex.  Second parent adoptions require a lifetime commitment to the relationship and to the child.

Child abuse and Child neglect
Joan Iacono represents parents accused or abusing or neglecting their children.  If children have been taken out of the home, Iacono helps the parents form a strategy to get the children back into the home or with a close relative as quickly as possible, with a goal of keeping the children out of foster care.  Then she looks at the issues that caused the child to be taken out of the home, whether that was an allegation of physical abuse, drug use, or another cause.  With her client, Joan Iacono forms a strategy to show the court what it needs to see to make a decision favorable to her client.  If the allegation is that a parent failed to protect his or her children, Iacono needs to show the court that the client has taken steps to correct the problem.  That may include drug treatment, parenting or anger management classes for the parent.
